IT – Il sito www.ridesphere.it (di seguito, “Piattaforma” o “RideSphere”) è una Piattaforma è dedicata alla promozione e vendita di servizi legati al mondo motociclistico. RideSphere opera esclusivamente come intermediario digitale tra fornitori di servizi indipendenti (i “Partner”) e i clienti finali (i “Clienti”). 

RideSphere non eroga direttamente alcun servizio, né assume la qualità di tour operator, organizzatore di eventi o prestatore dei servizi acquistati dai Clienti.

⁠I prezzi si riferiscono sempre a un solo Cliente, salvo diversa indicazione all’interno della descrizione del prodotto.

I servizi acquistati e non utilizzati non sono rimborsabili, salvo diversa indicazione nella descrizione del servizio.

EN – The website www.ridesphere.it (hereinafter, the “Platform” or “RideSphere”) is aimed to the promotion and sale of services related to the motorcycle world. 

RideSphere acts exclusively as a digital intermediary between independent service providers (“Partners”) and end users (“Clients”). 

RideSphere does not directly provide any services, nor does it act as a tour operator, event organizer, or provider of the services purchased by the Clients.

Prices always refer to a single Client, unless otherwise indicated in the product description.

Purchased and unused services are non-refundable, unless otherwise indicated in the service description.

1. Oggetto del servizio / Purpose of the Service

IT – RideSphere consente ai Clienti di:

  • consultare le offerte pubblicate dai Partner;

  • prenotare ed acquistare i relativi servizi;

  • effettuare pagamenti online tramite sistemi integrati.
    Il rapporto contrattuale relativo all’esecuzione dei servizi si instaura esclusivamente tra Cliente e Partner.

EN – Through RideSphere, Clients can:

  • view offers published by Partners;

  • book and purchase related services;

  • make online payments through integrated systems.
    The contractual relationship concerning service performance exists exclusively between the Client and the Partner.

 

 

2. Limitazione di responsabilità di RideSphere / Limitation of liability of RideSphere

IT – RideSphere si limita a pubblicare le offerte dei Partner, gestire le transazioni economiche e fornire assistenza di primo livello ai Clienti. 

RideSphere non è responsabile della conformità, qualità, sicurezza, regolarità ed effettiva erogazione dei servizi acquistati. Ogni reclamo, richiesta di rimborso o azione legale deve essere indirizzato esclusivamente al Partner.

RideSphere non sarà in alcun caso tenuta a rifondere:

• danni indiretti, consequenziali o perdita di profitto, dati o avviamento;

• importi superiori alla commissione percepita per la singola transazione oggetto di contestazione;

• inadempimenti o fatti imputabili a Partner o Clienti.

EN – RideSphere only publishes Partner offers, manages transactions, and provides first-level assistance to Clients. 

RideSphere is not responsible for compliance, quality, safety, regularity, or actual performance of the purchased services. Any complaint, refund request, or legal action must be addressed exclusively to the Partner.

RideSphere shall not have to refund, under any circumstances:

• indirect or consequential damages, including loss of profit, data, or goodwill;

• amounts exceeding the commission earned for the specific contested transaction;

• failures or acts attributable to Partners or Clients.

 

 

3. Responsabilità dei Partner / Partner Responsibilities

IT – Ogni Partner è l’unico responsabile di:

  • accuratezza e aggiornamento delle offerte;

  • esecuzione corretta e puntuale dei servizi acquistati;

  • rispetto delle normative vigenti, incluse licenze, requisiti di sicurezza e assicurazioni;

  • comunicazione delle eventuali coperture assicurative ai Clienti;

  • rimborso dei servizi venduti e non effettuati per causa propria.

EN – Each Partner is solely responsible for:

  • accuracy and update of offers;

  • proper and timely performance of purchased services;

  • compliance with applicable laws, including licenses, safety requirements, and insurance;

  • communicating any insurance coverage to Clients;

  • refund for services sold and not performed due to his own fault.

 

 

4. Obblighi dei Clienti / Client Obligations

IT – Il Cliente deve:

  • rispettare i requisiti richiesti (patente valida, DPI, briefing obbligatori);

  • attenersi alle regole stabilite dal Partner;

  • verificare la completezza delle informazioni ricevute.
    Il mancato rispetto dei requisiti può comportare l’esclusione dal servizio senza diritto a rimborso.

EN – The Client must:

  • comply with required conditions (valid license, protective equipment, mandatory briefings);

  • follow the rules set by the Partner;

  • verify the completeness of the information received.
    Failure to meet these requirements may result in exclusion from the service without refund.

 

 

5. Legge applicabile e foro competente / Governing Law and Jurisdiction

IT – Le presenti Condizioni sono regolate dalla legge italiana. Qualsiasi controversia è devoluta alla competenza esclusiva del Foro di Roma.

EN – These Terms are governed by Italian law. Any dispute shall fall under the exclusive jurisdiction of the Court of Rome.
